These Terms of Service ("Terms") govern your access to and use of the Bunc platform, website, and services ("Services") operated by Bunc ("we," "us," or "our"). By using our Services, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Services on behalf of a business, you represent that you have the authority to bind that business to these Terms.

2. Account Registration

  • You must provide accurate and complete information when creating your account.
  • You are responsible for maintaining the security of your account credentials.
  • You must notify us immediately of any unauthorized access to your account.
  • One person or business may not maintain more than one free trial account.

3. Services Description

Bunc provides an AI-powered business operating system that includes phone call handling, appointment booking, lead capture, and knowledge management. Our AI agents are trained on your business information to handle inbound calls on your behalf.

4. Acceptable Use

You agree not to:

  • Use the Services for any unlawful purpose or in violation of applicable laws.
  • Provide false or misleading business information to train your AI agent.
  • Use the Services to make unsolicited calls, spam, or engage in harassment.
  • Attempt to reverse-engineer, decompile, or extract source code from our platform.
  • Interfere with or disrupt the integrity or performance of the Services.
  • Resell or redistribute the Services without our written consent.

5. Payment Terms

  • Subscription fees are billed in advance on a monthly or annual basis depending on your selected plan.
  • All fees are non-refundable except as required by applicable law or as explicitly stated in these Terms.
  • We reserve the right to change pricing with 30 days' advance notice.
  • Overdue payments may result in suspension or termination of your account.

6. Free Trial

We may offer a free trial period. At the end of the trial, your account will be automatically converted to a paid subscription unless you cancel before the trial expires. We reserve the right to modify or discontinue free trials at any time.

7. Call Recording & Data

  • Calls handled by your AI agent may be recorded and transcribed.
  • You are responsible for complying with all applicable call recording laws and regulations in your jurisdiction, including obtaining caller consent where required.
  • You retain ownership of your business data. We retain a license to use your data to provide and improve the Services.

8. Intellectual Property

The Bunc platform, including its software, design, and content, is owned by us and protected by intellectual property laws. Your use of the Services does not grant you any ownership rights in our intellectual property. You retain ownership of your business content and data.

9. Limitation of Liability

To the maximum extent permitted by law, Bunc shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, data, or business opportunities, arising from your use of the Services. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that our AI agents will handle every call perfectly or that the Services will be uninterrupted or error-free.

11. Termination

  • You may cancel your account at any time through your account settings or by contacting support.
  • We may suspend or terminate your account for violation of these Terms, non-payment, or at our discretion with reasonable notice.
  • Upon termination, your right to use the Services ceases immediately. Your data will be retained for 30 days, after which it may be deleted.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-app notification at least 30 days before they take effect. Your continued use of the Services after changes become effective constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts located in San Francisco County, California.
